RULES

The following rules must be read carefully. In consideration of your membership at Century Cricket Centre Houston being accepted, you acknowledge and agree to the following rules:

GENERAL
  • All attendees of any booking are subject to the Rules, Terms and Conditions.
  • Dress Code: All users must wear appropriate clothing in line with an Indoor High-performance sporting facility and accompanying physical activity
  • All users must wear appropriate footwear suitable for the facility and accompanying physical activity
  • Spikes on footwear are strictly prohibited within the Century Cricket Centre.
  • Users must not enter the indoor cricket net area until their previously booked commencement time.
  • Members must not bring non-members into the Centre unless previously approved by Century Cricket Centre staff.
  • Members must not share their membership fob with any non-members, doing so will result in the termination of your membership.
  • Lane changeover period: Please note that your first 5 minutes and the last 5 minutes of your booking are used as a lane changeover period. Please be ready to exit the indoor center lanes 5 minutes before the end of your hire period.
  • All users must be out of the nets at the time their booking expires.
  • Bowling Machines are not to be operated until induction training has been completed.
  • Unsafe behavior or actions may result in the User or Users being asked to leave if deemed of significant and reasonable danger to others as deemed by Century Cricket Centre staff.
  • Users are not permitted to access any private areas within the Century Cricket Centre.
  • Users are only permitted to common/public areas within the Century Cricket Centre.
  • Consumption of alcohol is strictly prohibited prior to and during the use of the indoor facility
  • Members may not bring an external coach into the center unless otherwise approved by Century Cricket Centre
  • All members must wear full protective equipment including a helmet at all times when batting
  • Behavior with reasonable cause that results in damage or loss of Centre equipment will result in a relevant fee being charged to your membership
  • Any equipment used from the public training gear rack must be returned after your session
  • Your net must be clean, tidy and balls packed up at the completion of your session
  • There will be players of all ages using the facility and foul language, derogatory behavior or bullying won't be tolerated.
  • No food or drink is to be taken into the net area
  • Failure to adhere to any of the Centre rules will result in a warning, three warnings may result in your membership being terminated.
MINORS
  • Users under the age of 18 must be supervised by a parent/legal guardian outside of staffed hours
  • Users under the age of 18 may train unaccompanied by an adult during staffed hours (9am-5pm)
  • Users under the age of 18 are permitted to have a non-member parent assist them with training by throwing balls or feeding a machine
  • Minors must not be left unaccompanied after their session for more than 30 minutes.
FAMILY MEMBERSHIPS
  • A family membership allows all players on the membership access to the center
  • Family members must book and train in the same lane/net when training together unless previously approved to book multiple nets by Century Cricket Centre staff

BOOKING AND USE OF CENTURY CRICKET CENTRE TRAINING FACILITIES

The following terms and conditions must be read carefully. In consideration of your membership at Century Cricket Centre being accepted, you acknowledge and agree to the following terms and conditions:

"Claim" means and includes any action, suit, proceeding, claim, demand, damage, cost or expense however arising including but not limited to negligence.

"Cricket Activities" means the use or enjoyment of the Indoor Facilities or equipment therein.

"CCC" means the Century Cricket Centre and where the context provides, includes its officers, employees and agents.

"Indoor Facilities" mean the indoor training facilities, including but not limited to the indoor cricket nets, at the Century Cricket Centre.

"You" means the person named in this booking application.

Policies:

You acknowledge that when undertaking the Cricket Activities, You are bound by and must fully comply with all rules, policies and procedures of CCC as notified to You from time to time.

Booking:

To book the CCC facilities you must be a registered member.

Responsibility:

You acknowledge and agree that, unless that person's parent or guardian is also present at the Indoor Facilities, You are responsible for the behavior and safety of any person under the age of 18 participating in the Cricket Activities, and in consideration of Your booking for the Indoor Facilities being accepted by CCC, You to the extent permitted by law, agree to indemnify and keep indemnified, and hold harmless, CCC from and against any Claim caused or related to any person under the age of 18's participation in the Cricket Activities, save that the indemnity shall not apply to Claims caused or contributed to by the grossly negligent act or omission of CCC.

Risk Warning:

Your participation in the Cricket Activities supplied by CCC is inherently dangerous and may involve risk. There are risks specifically associated with participation in the Cricket Activities, including but not limited to being hit by a cricket bat or ball, including being hit in the head by a bat or ball, falling or tripping over a cricket ball, becoming entangled in the cricket nets, or colliding with other participants, and accidents can and often do happen which may result in personal injury, death or property damage. Prior to undertaking any such Cricket Activities, You should ensure You are aware of all the risks involved, including those risks associated with any health condition You may have. By agreeing to these terms and conditions, You acknowledge, agree and understand that participation in the Cricket Activities provided by CCC may involve risk. You agree and undertake any such risk voluntarily and at Your own risk. You will not participate in the Cricket Activities while intoxicated or affected by drugs. You acknowledge that the assumption of risk and warning above constitutes a 'risk warning' in accordance with relevant legislation.

Waiver, Release and Indemnity:

You agree that to the extent permitted by law:

  • You release and forever discharge CCC from all Claims that You may have or may have had but for this release arising from or in connection with Your participation in the Cricket Activities, and Your booking of the Indoor Facilities; and
  • You indemnify and will keep indemnified and hold harmless CCC to the extent permitted by law in respect of any Claim by any person arising as a result of or in connection with Your participation in any Cricket Activities, or your booking of the Indoor Facilities, save that the above releases and indemnities shall not apply to the extent that the loss, damage or injury that is the subject of the Claim is caused or contributed to by the grossly negligent act or omission of CCC.

Moreover, you to agree to the terms of the Customer Agreement, Release, Assumption of Risk, Waver of Liability, Indemnification, and License Agreement (which is incorporated herein by reference).

If You agree to these terms and conditions, You will be agreeing that Your rights (or the rights of a person for whom or on whose behalf You are acquiring the services) to sue the supplier in relation to recreational services or recreational activities that You undertake because the recreational services or recreational activities provided were not in accordance with the guarantees are excluded, restricted or modified as set out herein.

Fitness to Participate:

You declare that You are medically and physically fit and able to participate in any Cricket Activities. You will immediately notify CCC of any change to Your medical condition, fitness or ability to participate. You understand that if CCC was not provided with all relevant and necessary information about Your health and capacity it would not be able to fully appreciate the risk of harm or injury to You in providing instruction and in allowing You to participate in the Cricket Activities. You understand that CCC will continue to rely upon this declaration as evidence of Your fitness and ability to participate. You agree to report any accidents, injuries, loss or damage that You suffer during any Cricket Activities to CCC before You leave CCC. If You suffer any injury or illness, You agree that CCC may provide evacuation, first aid and/or medical treatment at Your expense and that Your agreement to these terms and conditions constitutes Your consent to such evacuation, first aid and/or medical treatment.

Insurance:

You acknowledge and agree that CCC has arranged some limited insurance coverage which may provide You with some protection for loss, damage or injury that You may suffer during our participation in the Cricket Activities. However, You acknowledge and agree that the insurance taken out by CCC may not provide full indemnity for loss, damage or injury that You may suffer during Your participation in the Cricket Activities and that You may have to pay the excess if a Claim is made on Your behalf. You agree that Your own insurance arrangements are ultimately Your responsibility and You will arrange any additional coverage at Your expense after taking into account CCC's insurance arrangements and Your own circumstances.

Privacy:

You understand that the personal information You have provided in this booking application is necessary for the administration of Your booking of the Indoor Facilities, CCC's conduct and management of the Cricket Activities and that it is collected in accordance with the CCC Privacy Policy, as amended from time to time by CCC and which is incorporated herein by reference.

Severance:

If any provision of these terms and conditions is invalid or unenforceable, the phrase or clause is to be read down, if possible, so as to be valid and enforceable. If the phrase or clause cannot be so read down it will be severed to the extent of invalidity or unenforceability. Such severance does not affect the remaining provisions of these terms and conditions.

Cancellation:

A two-week cancellation notice period is required from members to cancel their current membership.

Governing Law:

The governing law of these terms and conditions is the law of the State of Texas. You irrevocably and unconditionally consent and submit to the jurisdiction of the courts of Texas in which any incident occurs and waive any right to object to the exercise of such jurisdiction.
